Terms of Use

Please read these Terms of Use ("Terms") carefully before using the Orbit mobile application or website operated by Respawn Technologies Pvt Ltd ("we", "us", or "our"). By downloading, installing, accessing, or using Orbit, you agree to be bound by these Terms. If you do not agree, do not use Orbit.

1. Eligibility

You must be at least 13 years old to use Orbit. By using the app, you represent that you meet this age requirement. If you are under 18, you confirm that you have obtained consent from a parent or guardian.

2. Account Registration

To use Orbit, you must create an account using a valid email address and mobile phone number. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately at rohan@useorbit.in if you suspect unauthorised use of your account.

You agree to provide accurate, current, and complete information during registration and to update it as necessary to keep it accurate.

3. Acceptable Use

You agree to use Orbit only for lawful purposes and in accordance with these Terms. You must not:

— Harass, threaten, or harm other users
— Upload content that infringes the intellectual property or privacy rights of others
— Distribute spam, malware, or harmful code
— Attempt to gain unauthorised access to our systems or other users' accounts
— Scrape, reverse-engineer, or decompile any part of the app
— Use Orbit for any commercial purpose without our prior written consent
— Violate any applicable local, national, or international law or regulation

We reserve the right to remove content or suspend accounts that violate these rules.

4. Your Content

You retain ownership of all content you save, upload, or share through Orbit ("Your Content"). By using Orbit, you grant us a limited, non-exclusive, royalty-free licence to store, process, and display Your Content solely to operate the service for you and the members of your orbits. We do not claim any ownership over Your Content.

You are solely responsible for Your Content and represent that you have all necessary rights to share it through Orbit.

5. SMS Messaging Terms

Orbit uses SMS exclusively to deliver one-time passcodes (OTPs) for account verification and login via our provider MSG91 (Walkover Web Solutions Pvt Ltd). By providing your phone number during sign-up or login, you consent to receive a single SMS containing your verification code when you request it.

Message frequency: One message per verification request. We do not send marketing, promotional, or recurring SMS messages.

Message and data rates may apply. Standard carrier rates for SMS and data may apply depending on your mobile plan.

Your phone number is transmitted to MSG91 solely for OTP delivery and is not used for any other purpose. Carriers are not liable for delayed or undelivered messages.

6. iOS — Apple App Store Terms

If you download Orbit from the Apple App Store, the following terms apply in addition to these Terms:

Licence: Your licence to use Orbit on iOS devices is limited to a non-transferable licence to use the app on any Apple-branded product that you own or control, as permitted by the App Store Usage Rules set forth in Apple's Terms of Service.

Maintenance and support: Respawn Technologies, not Apple, is solely responsible for providing maintenance and support services for Orbit. Apple has no obligation to provide any maintenance or support services with respect to Orbit.

Warranty: In the event Orbit fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the app (if applicable). To the maximum extent permitted by law, Apple has no other warranty obligation with respect to Orbit.

Product claims: Respawn Technologies, not Apple, is responsible for addressing any claims you or any third party may have relating to Orbit or your use of it, including: (a) product liability claims; (b) any claim that Orbit fails to conform to any applicable legal or regulatory requirement; and (c) claims arising under consumer protection or similar legislation.

Third-party beneficiary: Apple and Apple's subsidiaries are third-party beneficiaries of these Terms. Upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.

Intellectual property: In the event of any third-party claim that Orbit or your possession and use of Orbit infringes that third party's intellectual property rights, Respawn Technologies, not Apple, will be solely responsible for the investigation, defence, settlement, and discharge of any such intellectual property infringement claim.

Export compliance: You represent and warrant that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.

7. Android — Google Play Store Terms

If you download Orbit from the Google Play Store, your use of the app is also subject to Google Play's Terms of Service. In the event of any conflict between these Terms and Google's terms, Google's terms shall govern with respect to your use of the Play Store.

Google LLC is not a party to these Terms and is not responsible for Orbit or its content. All support, warranty, and liability obligations rest solely with Respawn Technologies as described in these Terms.

8. Intellectual Property

The Orbit app, website, brand, name, logo, design, and all associated content and technology are owned by Respawn Technologies Pvt Ltd and are protected by applicable intellectual property laws. You may not copy, reproduce, distribute, modify, or create derivative works from any part of Orbit without our prior written consent.

9. Third-Party Services and Links

Orbit may integrate with or display content from third-party platforms (e.g. Instagram, TikTok, YouTube). We are not responsible for the content, privacy practices, or terms of those third parties. Your interactions with third-party services are governed by their respective terms and policies.

10. Disclaimers

Orbit is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the service will be uninterrupted, error-free, or free from viruses or other harmful components. Your use of Orbit is at your sole risk.

11. Limitation of Liability

To the fullest extent permitted by applicable law, Respawn Technologies Pvt Ltd shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, revenue, or goodwill, arising out of or in connection with your use of or inability to use Orbit, even if we have been advised of the possibility of such damages.

12. Termination

We may suspend or terminate your access to Orbit at any time, with or without cause or notice, if we believe you have violated these Terms or applicable law. You may delete your account at any time through the app or by emailing rohan@useorbit.in. Termination does not affect any rights or obligations that arose before the termination date.

13. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated via in-app notification or email at least 7 days before taking effect. Continued use of Orbit after a change constitutes your acceptance of the updated Terms.

14. Governing Law and Disputes

These Terms are governed by and construed in accordance with the laws of India, without regard to conflict of law principles. Any dispute arising from these Terms or your use of Orbit shall be subject to the exclusive jurisdiction of the courts of Mumbai, Maharashtra, India.
